Welcome to Solid State Septic. By scheduling, authorizing, or receiving services, you agree to these Terms & Conditions. Please read them carefully.
Solid State Septic is a California sanitation system contractor, CSLB C-42 License No. 1128200. Contractors are required by law to be licensed and regulated by the Contractors State License Board. Any questions concerning a contractor may be referred to the Registrar, Contractors State License Board, P.O. Box 26000, Sacramento, California 95826.
1. Services
We provide onsite wastewater (septic / OWTS) services in San Diego County, including:
- Septic pumping and tank cleaning
- Inspection, certification, and home-purchase inspections
- Repair and maintenance
- System design support, site evaluation, and permitting assistance
- Installation and replacement
- Drainage work that protects the property and the onsite system
All work is subject to access, site conditions, equipment limits, and applicable federal, state, and county rules, including San Diego County DEHQ and the State Water Resources Control Board OWTS Policy.
We do not discharge septic effluent to creeks, ditches, culverts, or storm drains, and we do not perform work that would violate those rules.
2. Estimates and pricing
Estimates are based on information available at the time they are given. Price may change if we find buried lids, rock, groundwater, unmarked utilities, a larger or different system than described, extra pumping volume, county conditions, or customer-requested changes.
Written estimates are valid for 30 days unless the estimate says otherwise. Changed work requires a written change order.
3. Permits and compliance
New systems, replacements, and most major repairs require a county permit, usually from San Diego County DEHQ. Pumping and routine maintenance generally do not.
When permitting is included in the scope, we prepare and submit the package and schedule required inspections. Permit fees, engineering, percolation tests, and outside-consultant costs are extra unless the estimate says they are included.
Final approval belongs to the county or other agency. We cannot guarantee that DEHQ or any other authority will approve a design or existing system.
You must give accurate property and system information, including bedroom count, known wells, prior permits, and easements.
4. California home improvement contracts
Installation, replacement, and other home improvement work at or above the threshold in California Business and Professions Code section 7159 will be set out in a written contract that meets California law. That contract controls if it conflicts with these terms.
California limits the deposit that may be collected before work starts on qualifying home improvement contracts (generally the lesser of $1,000 or 10 percent of the contract price, excluding finance charges). Progress payments must track work actually completed.
5. Right to cancel
If California’s home solicitation or home improvement cancellation rules apply, you may cancel the contract within three business days after you sign it (longer if the law gives a longer period). We will provide the notice-of-cancellation form required by law with that contract. Emergency work you request to protect people or property may be treated as you direct in a signed authorization.
6. Scheduling and access
You must provide safe, reasonable access for people and the service truck, including a path to the tank and drainfield.
Tank lids must be exposed unless you booked locate-and-uncover service. Buried lids, locked gates, vehicles over the tank, pets, or unsafe conditions can delay the job and may incur a trip or reschedule fee.
Weather, county inspections, rock, groundwater, and equipment breakdowns can change the schedule.
7. Payment
Payment terms are stated on the estimate, contract, or invoice. Payment is due on completion unless we agree otherwise in writing.
Late amounts may accrue interest at the maximum rate allowed by California law, plus reasonable collection costs. We may pause unfinished work on a past-due account.
8. Your responsibilities
You agree to:
- Disclose known problems, prior failures, wells, and easements
- Avoid putting grease, wipes, solvents, and non-biodegradable items into the system
- Use the system within its design load
- Keep children, pets, and bystanders out of the work area
- Mark or have utilities marked when excavation is planned
- Confirm property lines when the work is near a boundary
9. Septage and environmental rules
Waste removed from a tank will be transported and disposed of at an authorized facility in accordance with applicable health and environmental rules. You authorize us to handle that material as part of pumping or cleaning.
10. Limits of liability
We are not responsible for pre-existing damage or defects that were not reasonably visible during the agreed scope of work.
We are not responsible for damage caused by misuse, neglect, overloading the system, or failure to follow maintenance advice, including a recommended pump interval.
To the extent permitted by California law, our liability for claims arising from the services is limited to the amount you paid for the specific service that gave rise to the claim. We are not liable for lost use, lost rent, or other consequential damages except where California law does not allow that limit.
Nothing in these terms limits liability for fraud, willful injury to person or property, or other claims that cannot be limited under California law.
11. Warranties
Any workmanship or materials warranty will be stated in writing for that job. Pumping, cleaning, and inspections do not guarantee that the system will not fail later.
Except for written warranties we give you, and except for warranties that California law does not allow us to disclaim, services are provided as performed. We do not promise that an existing drainfield, tank, or soil condition will meet future county standards or last a stated number of years unless that promise is in writing.
12. Grounds and restoration
Excavation, truck access, and tank work can disturb lawn, gravel, driveways, and irrigation. We will take reasonable care. Backfill and basic grading are included when they are part of the scope. Landscape replacement, concrete, paving, and irrigation repair are not included unless the written estimate says so.
13. Mechanics lien notice
Under California law, persons who furnish labor or materials to your property may record a mechanic’s lien if they are not paid. That can lead to a foreclosure action. When required, the full statutory notice will appear in your home improvement contract.
14. Cancellations
Cancel at least 24 hours before a scheduled pump, clean, or inspection. Late cancels and no-shows may be charged a reasonable trip fee. Permit, engineering, and custom-order costs already incurred remain payable.
15. Health and safety
Septic tanks contain sewage and dangerous gases. Stay clear of open lids, excavations, and equipment. We may stop work if the site is unsafe.
16. Emergency service
After-hours and emergency work is offered when we can staff it. Extra charges apply and will be disclosed when you call, or as soon as the conditions are known.
17. Photos and records
You authorize reasonable job photos and records for the file, permitting, and quality control. We will not sell those images as advertising without your consent.
18. Governing law
These terms are governed by the laws of the State of California. Venue for disputes is in the California county where the work was performed, unless the written contract says otherwise.
19. Changes to these terms
We may update these terms. The version in effect when you schedule the job applies to that job, unless a signed contract says otherwise.
20. Acceptance
Scheduling or receiving services means you have read and agree to these Terms & Conditions.
